How to register in a new building in Ukraine

What documents do you need to have for successful registration of ownership of an apartment in a new building?

Registration of ownership of real property is carried out only by entering information into the State Register of Proprietary Rights to Immovable Property. To do this, you first need to turn to a notary, having collected a full package of necessary documents in order to avoid refusal or other issues that may arise during the registration process.

Documents that must be provided to the state registrar or notary for household registration in Ukraine:/p>

  • application for household registration;
  • passport and identification code copies;
  • original technical data sheet of the apartment;
  • act of acceptance and transfer of real property;
  • agreement with the developer (purchase and sale agreement, investment agreement, equity participation agreement or other options for cooperation);
  • receipt of payment of the administrative fee (the amount of the fee starts from UAH 215);
  • additional documents.

It is important that the technical data sheet of the property meets all the requirements and includes information about all changes to the apartment layout that were made by the developer after the master plan of the facility was agreed. A public utility company or a private Technical Inventory Bureau (TIB) can develop and issue a technical passport for an apartment only if it has a special qualification certificate. In the case of the state TIB, the term for producing a technical data sheet is usually 30 days, while private bureaus offer terms for issuing a document from several days.

Submission of a package for state household registration of an apartment in a new building

After collecting all the necessary documents for state registration, you need to turn to the state registrar or notary. Based on the application and the submitted package of documents, the registrar makes a decision on state household registration of the real property. The reason for the refusal to register in the apartment may be the absence of any of the necessary documents attached to the application. This can be avoided if all the necessary documents are prepared in advance and carefully, or by placing confidence in lawyers. If the state registrar satisfies the application and decides to register the ownership of the apartment, then they must make a corresponding entry in the State Register. All that remains is just to receive a statement of ownership of the apartment, which confirms that the property belongs to you.

What is an extract from the State Register of Proprietary Rights to Immovable Property

A statement, or an extract from the State Register of Proprietary Rights to Immovable Property, is a document that allows you to establish the legal status of real property. The extract contains basic information about the owner of the household, as well as about the apartment itself and the legal burdens imposed on it. The information is divided into three parts:

  1. the first part — information about the extract: index number of the extract, date and time of completion of the document, address of the responsible department of justice;
  2. the second part — information about the time of state registration of property rights and the registrar, information about the owner or perpetual usufructuary of real estate, grounds for the emergence of ownership right, for example, a sales contract, donation or inheritance;
  3. the third part — information about the property: location address, total area, wall material and other information.

An extract from the State Register of Proprietary Rights to Immovable Property can be obtained from local councils, through administrative service centers, or by turning to a notary who will submit documents for registration of ownership right.

Terms and conditions of family members registration

Registration of family members, people who are not homeowners, is carried out by the administrative service centers at the place of residence. To register family members, the home owner has to submit the following documents:

  • passport and TIN copies;
  • original receipt of payment of the court fee;
  • an extract from the State Register of Proprietary Rights to Immovable Property;
  • certificate of family composition.

Usually, children are registered at the registration address of one of the parents without the mandatory consent of the home owner. To register a child in a new apartment, the following documents are required:

  • statement;
  • birth certificate of the child (original and copy);
  • receipt of payment of the administrative fee;
  • original and copy of passport of the parent – the home owner.
