Information on the lawsuits and legality of the Park Life project

Recently, many manipulative publications have appeared in the information space, characterizing our Park Life project as illegal, being built on the territory of a park, and having a number of lawsuits. This information is not true.

Therefore, we would like to point out that Park Life is being built in a non-park area at 1-3 Henerala Shapovala Street, Kyiv, on a plot intended for construction, where a motor transport company has been located since 1965. At the same time, there are other residential complexes nearby, and some residents are not happy with the new building. Therefore, throughout the entire period of the project, they have been artificially creating obstacles to our construction. In particular:

  • block roads;
  • damage expensive construction equipment;
  • initiate pressure from local governments and supervisoty authorities, law enforcement agencies;
  • organize unauthorized pickets and rallies;
  • disseminate distorted information in the media;
  • make numerous other attempts to stop our work.

In addition, in order to make it impossible to implement the project, these individuals artificially and unjustifiably initiate litigation demanding the recognition as illegal and the cancellation of title and permits.

In order to avoid further misunderstanding and the emergence of fake and false reports, we would like to inform you as follows.

The user of the land plots where the construction works are underway is Smart Development Limited Liability Company, which acts as the construction customer. The company obtained the right to use the land plots in accordance with the procedure. Cadastral numbers of the plots are as follows:

  • No. 8000000000:72:186:0006, with an area of 1.1901 hectares for the construction and maintenance of a mixed-use complex, a hotel, office buildings and retail premises with underground parking, leased on the basis of the decision of the Kyiv City Council No. 1870/5934 dated 11.10.2018;
  • No. 8000000000:72:186:0067, with an area of 0.0803 hectares for the construction of transport infrastructure, leased on the basis of the decision of the Kyiv City Council No. 1438/5502 dated 20.09.2018;
  • No. 8000000000:72:186:0046, with an area of 0.1866 hectares for the operation and maintenance of buildings and structures of motor transport company, leased on the basis of the decision of the Kyiv City Council No. 1869/5933 dated 11.10.2018.

It is also important to note that by Order No. 1184 dated 24.09.2019, the Department of Urban Planning and Architecture of the executive body of the Kyiv City Council (Kyiv City State Administration) approved the Urban Planning Conditions and Restrictions for the design of hotel, office and multifunctional buildings at 1-3 Henerala Shapovala Street in Solomianskyi District of Kyiv. Within the framework of the urban planning conditions and restrictions set by the applicable laws, the project documentation was developed. After that, it passed the expertise, which resulted in a positive Expert Report on the review of the project documentation for the construction of the Project “Construction of Hotel, Office and Multifunctional Buildings at 1-3 Henerala Shapovala Street in Solomianskyi District”.

On 10 September 2021, the State Architectural and Construction Inspectorate of Ukraine issued the Construction Permit No. ІУ013210903187 for the Project “Construction of Hotel, Office and Multifunctional Buildings at 1-3 Henerala Shapovala Street in Solomianskyi District”. The permit was granted to Smart Development LLC and Miskbudaliance LLC as the construction customers.

All of the documents described above are valid and were adopted in compliance with the applicable laws at the time of their adoption and the official procedure.

The undeniable facts of legality are also the fact that in two years of court proceedings, no positive decision has been made in favour of the residents of neighbouring complexes. As a security for the claims, neither the construction permit nor the urban planning conditions and restrictions have been suspended, nor has the process of construction work been suspended.

Thus, the construction is carried out in accordance with duly approved project documentation, construction permits, and other approvals for construction and meets the state standards, construction codes, and regulations for this type of construction.

Our team has always demonstrated openness and willingness to communicate with the community and the media. We are ready and are already contributing to the improvement of Solomianskyi Park. We would also like to emphasize that the construction customers and contractors involved in the process, as well as their counterparties, are bona fide business entities. Despite the pandemic, martial law, crisis in the construction market, rapid depreciation of hryvnia and rising prices, they fulfill their obligations to investors, create jobs, pay taxes and help the Ukrainian Defence Forces.

In view of the above, we urge media representatives to carefully analyze the facts, avoid inaccuracies and manipulations in favour of one of the parties.
